Do Men have Human Rights ??
Summary:- Human Rights are moral
principles or norms that describe certain standard of human behavior & are
protected as legal rights. They are commonly understood as inalienable
fundamental rights to which a person is inherently entitled. They are
egalitarian in terms as ubiquitous for all. However the legal ammunition meant
to protect an individual interest is viewed differently. The extremist vision
of men as perpetrator has commonly led to several gender biased law with a
prejudice. Several
laws framed with this purview are not only Anti Male as well as Gender biased & Anti Society completely
defying the laws of natural justice. Even the pragmatic approach of these
gender biased laws have led to violation of Human rights under the corporality.
The social empathy & trauma
of men are evident with UN studies on
trend of suicide. Worldwide, the phenomena replicates all across, globally male
suicides are twice that of female. It expresses the melancholy of men. Sorry
state precipitates in the social fiber of India where India appears to be
numero uno in male suicides across the world. National Crime Record Bureau
envisages family disputes as the single largest reason for male suicides. The
situation is much more concerning because the country observes enlightened
activism towards empowerment of women. However the empathy for men is
exorcised.
What
Stops legislators to raise an alarm bell towards this concerning trend is yet
to be identified. where under the family disputes interest of women is
thoroughly protected by Domestic violence act & several others matrimonial
laws, under similar circumstances male voice gets choked. Failure to recognize
and record male issues is the major reason of distress. Laws formulated to suit
a particular gender with prima facie assumption of individual testimonials to
be true has held men hostage of biased laws. In case of a family dispute men
have no respite other than to succumb to law or life.
Cruelty
has different dimensions for genders as well .where family values have been
crumbling, outcome of fragmenting family merits. Set legal implications are
defined to punish cruelty by husband on wife on the contrary cruelty by wife on
husband has no legal grounds. Its defending the undefendable to suggest cruelty
is virtue of gender alone. A gross violation of Human rights still widely
acceptable law in Indian Society. Ill
famed law has critically acclaimed by all scores of society, still legislators
unmoved of the agony men undergo. The law bears black spot in legal system with
highest no of women arrested in any crime. 24 % of all women arrested originate
from this law. leave aside elderly abuse and innocent children pushed behind bars.
The
legal turnout of an alarm raised by women considered sacrosanct has led to out burn of Human rights violation. “Innocent
till proven guilty” exist in the UN charter buried under an epitaph. A senior retired justice of Supreme court also
the than Chairman of west Bengal human right commission had to resign from the
duties on media trial , even without an FIR being registered .Dignity of
innocent has no worth another hyped
incident of media trial , where 2 sisters from rohtak vehemently beated 3 boys
black & blue were christened brave hearts . It soon dissipated with the
revelation by co-passengers and eyewitness as an incident of minor altercation.
3 careers ruined and 5 families traumatized. The matter declared fit for fast
track courts has now found a snail pace when the justice to men is expected.
Freedom
of speech has new lows a very Senior politician had to apologize for his
apprehension of keeping a women companion at work. what scope men have to rely
when they are primarily assumed guilty till proven innocent.
The
biggest consideration for warring spouse are their children who bear the brunt
of shattering relationship. Shared parenting conceptually is non existent. In
more than 90% of the case of getting child custody for fathers is a distant
dream. Leave alone the custody battle getting visitation rights requires
efforts from father from tooth to nail. Even animals do have the privilege to
reciprocate affection with their bloodline.
Sexual abuse of male child struggles to
even get a mention as crucial issue. Implementation of labor laws has never
gained momentum and finding the dust. With india thriving with the world’s
biggest share of child labor mostly boys engaged in hazardous jobs. The
compassion for men is seen dying a silent death.
Men right violation has
registered an exponential growth & even doesn’t seem to be pleatue-ing.
What bigger violation can be expected nevertheless with absenteeism of a
statutory body for men. Bare minimum
task to identify and acknowledge issues of men. Men right activist prolonged
demand of Men commission and Men ministry falling in deaf ears.
Issues are
numerous with very few takers. Men right does not exist in good Human rights.
The equilibrium of justice has tilted and Men are left to ask “Do Men have
Human Rights “??
